Privacy Policy

Last Updated: August 25, 2026

1. Introduction

Deck Experts LLC ("we", "our", or "us") is committed to protecting the privacy of our users. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website deckexpertsny.com (the "Site") or use our services. Please read this privacy policy carefully. If you do not agree with the terms of this privacy policy, please do not access the site.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the "Last Updated" date of this Privacy Policy. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on the Site. You are encouraged to periodically review this Privacy Policy to stay informed of updates.

2. Geographic Scope and Intended Audience

Deck Experts LLC is based in Albany, New York, and provides deck building and home remodeling services in Albany and the surrounding Capital Region of New York State. The Site is intended for, and directed to, prospective and existing customers located in our service area within the United States. We do not market or offer our services outside of this area.

If you choose to access the Site or submit information to us from another state or country, you do so on your own initiative and at your own risk, and you are responsible for complying with any laws that apply to you. Your access does not create any obligation on our part to provide services outside our service area, and nothing on the Site is intended as an offer or solicitation in any jurisdiction where such an offer or solicitation would be unlawful. We make no representation that the Site or its content is appropriate or available for use in any particular location.

3. Collection of Your Information

We collect information about you only when you voluntarily submit it through the contact form on the Site, and we collect limited technical information automatically when you visit the Site.

Personal Data You Provide

When you submit a quote request through our contact form, we collect the name, email address, phone number, and any message you choose to provide, along with any optional project details you choose to share (the service you are interested in, the status of your project, an estimated budget range, a preferred timeline, and your city or town). You may also optionally attach files — images or PDF documents such as photos of your existing space or project plans — to your submission. You are under no obligation to provide this information, but without your contact details we cannot respond to your inquiry.

Automatically Collected Information

Our hosting provider and the Cloudflare Turnstile service we use to block automated submissions log limited technical information, including your IP address, browser type, operating system, and the time of your visit. This information is used to deliver the Site, enforce rate limits on the contact form, and protect against abuse. We do not combine this information with your personal data unless necessary to investigate a security incident.

Search Performance Data

We use Google Search Console to understand how the Site appears in Google search results, such as which search queries lead people to the Site. Google provides this data to us in aggregated form; it does not identify individual visitors, and it does not involve placing any tracking code, cookie, or script on the Site. The public pages of the Site may also be crawled and indexed by search engines and AI assistants; those pages do not contain your personal information.

4. Your Responsibility for the Information You Provide

You provide information to us voluntarily, and you are solely responsible for the accuracy, completeness, and legality of any information you submit through the Site. By submitting information, you represent and warrant that: (a) the information is truthful and relates to a genuine inquiry about our services; (b) you are at least 18 years old; and (c) if you provide personal information about anyone other than yourself (for example, a co-owner, spouse, or tenant), you have that person's authorization to share their information with us for the purposes described in this Privacy Policy.

We are not responsible for personal information that you choose to disclose to us that we did not request, and we ask that you not send us sensitive information (such as financial account numbers, government-issued identifiers, or health information) through the contact form. If you submit information about a third party without proper authority, or you provide information that is inaccurate or unlawful, you — and not Deck Experts LLC — are responsible for the consequences of doing so. We may delete, or decline to act on, any submission at our discretion.

5. Use of Your Information

We use the information you submit solely to respond to your inquiry, prepare and communicate estimates, and provide the deck building and home remodeling services you request. Specifically, we may use information collected about you to:

  • Respond to your inquiries and contact you regarding the services you have requested.
  • Prepare and deliver quotes or estimates.
  • Schedule on-site visits or consultations related to your project.
  • Resolve disputes and troubleshoot problems.
  • Comply with our legal obligations and enforce our Terms of Service.

We do not send marketing or promotional communications, and we do not sell or rent your personal information to third parties.

6. Disclosure of Your Information

We may share information we have collected about you in limited circumstances:

By Law or to Protect Rights

If we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation.

Service Providers

We rely on third-party service providers to operate the Site and deliver your submissions to us. These include our hosting provider, our email relay provider, and Cloudflare Turnstile (for bot protection). Each of these providers processes only the information necessary to perform its function and is contractually required to safeguard your information.

Business Transfers

If we are involved in a merger, acquisition, or sale of all or a portion of our assets, any personal information you have provided may be transferred as part of that transaction. If such a transfer occurs, we will take reasonable steps to notify you and inform you of any choices you may have regarding your information.

7. Cookies and Tracking

The Site does not set cookies on your device and does not use analytics, advertising, or other tracking technologies. Cloudflare Turnstile, which protects the contact form from automated submissions, may set a short-lived challenge token as part of its verification process; this token is used only to validate your submission and is not used for tracking. For more detail about the limited technology the Site relies on, see our Cookie Policy.

8. Security of Your Information

We take reasonable steps to protect the information you submit:

  • All submissions are transmitted over HTTPS (TLS), so they are encrypted in transit.
  • Submissions, including any files you attach, are not stored in a database or uploaded to any cloud storage service. They are relayed as email to our business inbox over an authenticated SMTP connection.
  • The contact form is protected by per-IP rate limiting and a CAPTCHA challenge to reduce the risk of abuse.
  • Access to the business email inbox is restricted to authorized personnel.

No security measure is perfect, and no method of transmission over the Internet can be guaranteed against interception. We will notify affected New York residents and the New York Office of the Attorney General in the event of a qualifying security breach, as required by the New York SHIELD Act.

9. Your Rights Regarding Your Information

You have the following rights regarding the personal information we hold about you:

Right to Access

You may request a copy of the personal information we hold about you.

Right to Correction

If any of our records about you are inaccurate, you may ask us to correct them.

Right to Deletion

You may ask us to delete the personal information we hold about you at any time.

Right to Opt Out

You may ask us to stop contacting you at any time.

To exercise any of these rights, email info@deckexpertsny.com. We will respond within a reasonable period and may ask you to verify your identity before acting on your request.

10. Your Privacy Choices — We Do Not Sell or Share Your Personal Information

We do not sell your personal information, and we do not share it with third parties for cross-context behavioral advertising or for those third parties' own marketing purposes. Because we do not engage in these activities, there is no sale or sharing of your personal information for you to opt out of. We also do not use your information to build advertising profiles.

To the extent any applicable privacy law provides you with rights to access, correct, or delete your personal information, or to opt out of its sale or sharing, you may exercise those rights, or ask us any question about how we handle your information, by emailing info@deckexpertsny.com. We will not discriminate against you for exercising any privacy right.

You can also record this preference at any time using the "Your Privacy Choices" link in the footer of the Site. Your selection is stored in your browser and is included with any contact form submission you send us so that we have your choice on record.

11. Data Retention

We retain contact form submissions, including any files you attach, in our business email inbox until you ask us to delete them. To request deletion, email info@deckexpertsny.com. We may retain information for longer where required to comply with a legal obligation or to defend against legal claims.

12. Children's Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected information from a child under 13, we will delete it. If you believe a child has provided personal information through the Site, please contact us.
